When someone passes away without having proper or complete estate planning in place, a court-supervised process called probate may be required before property can be distributed to the decedent’s heirs or beneficiaries. Assets are distributed in accordance with the instructions written in the decedent’s last will and testament. If there was no will, then the items will be distributed as the court directs.
